DISFUNGSI KULTURAL DALAM PENEGAKAN HUKUM ANTIKORUPSI DI INDONESIA

Upaya pemberantasan korupsi di Indonesia telah berlangsung secara struktural dan normatif melalui pembentukan regulasi serta institusi penegak hukum. Namun, efektivitas penegakan hukum sering kali terhambat oleh faktor-faktor non-yuridis, salah satunya adalah budaya hukum yang permisif terhadap korupsi. Artikel ini mengkaji disfungsi kultural sebagai hambatan utama dalam upaya penegakan hukum antikorupsi. Dengan pendekatan sosiologis dan yuridis, artikel ini menelaah bagaimana nilai, norma, dan perilaku masyarakat turut membentuk realitas hukum yang tidak mendukung pemberantasan korupsi

Abstract
Efforts to eradicate corruption in Indonesia have been carried out structurally and normatively through the establishment of regulations and law enforcement institutions. However, the effectiveness of law enforcement is often hindered by non-legal factors, one of which is a legal culture that is permissive toward corruption. This article examines cultural dysfunction as a key obstacle in the fight against corruption. Using both sociological and juridical approaches, it explores how values, norms, and social behavior contribute to shaping a legal reality that does not support anti-corruption efforts.
